Terms of Use

These terms apply to the TalkFishing iPhone app and this website, provided by Stixx Digital Ltd, registered in England and Wales, company number 11767230, registered office Suite 128 Icentre, Howard Way, Newport Pagnell, Buckinghamshire, MK16 9FX, United Kingdom ("we", "us"). Contact: support@talk.fishing.

By using TalkFishing you agree to these terms and to Apple's Licensed Application End User Licence Agreement.

1. Using the app

We give you a personal, non-transferable licence to use TalkFishing on Apple devices you own or control, for your own non-commercial use. Please don't copy, resell, reverse engineer or misuse it.

2. Your content

Your voice notes, photos, trips and notes belong to you and are stored on your phone. You're responsible for what you choose to share, including having permission to share photos of other people.

3. Fishing safely and legally

TalkFishing is a logbook, not advice. You're responsible for your own safety near water, especially at night and on the coast; for holding the right fishing licence and permits for wherever you fish; for following fishery, club, close season and landowner rules; and for only fishing where you have permission. Never use the app while driving.

4. Accuracy

Catch details, place names, moon phase, tide guides, sunrise and sunset, pressure, tips and nearby waters are worked out automatically and may be wrong. Tide guides are based on the moon and are not tide tables. Nearby water suggestions do not mean fishing is allowed there. Please check anything important yourself.

5. Subscriptions and payments

Some features may need a paid subscription. Prices, trial length and renewal terms are shown before you buy. Payment is taken by Apple. Subscriptions renew automatically unless you cancel at least 24 hours before renewal, in iPhone Settings, your name, Subscriptions. Refunds are handled by Apple at reportaproblem.apple.com. Nothing in these terms affects your legal rights as a consumer.

6. Beta testing

Test versions may have bugs and missing features and could lose data, so please back up. Feedback you send us may be used to improve TalkFishing.

7. Backups and data loss

Your data is stored on your phone. If you lose or reset your phone, your trips may be lost unless you've made a backup. We're not responsible for data lost this way.

8. Changes and availability

We may update the app, this website and these terms. We'll tell you in the app about important changes. We may change or stop features, and will try to give notice first.

9. Our liability

We're responsible for losses you suffer that are a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for losses that weren't foreseeable, for business losses, or for anything caused by your own actions on the bank or on the water. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't legally be limited.

10. Ending your use

You can stop using TalkFishing at any time and delete your data in the app. We may stop your access if you break these terms.

11. Law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring claims in your local courts.

12. Apple

Apple is not responsible for TalkFishing or its content, maintenance, support or any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
